UCAN2 DANCE STUDIO GENERAL TERMS AND CONDITIONS

These terms and conditions affect your legal rights. It is important that you read this agreement carefully before making a purchase. By signing this agreement or by selecting “I agree to the Terms and Conditions” you acknowledge that you have read, understood and agreed to be bound by the terms and conditions in this agreement. If you are making a purchase on behalf of another person, you agree that you are their agent so that they will be bound by this agreement.

UCAN2 DANCE STUDIO LIMITED (NZBN: 9429038030192) (Trading as UCan2 Dance Studio) as the supplier of recreational services, sells all tickets and supplies all recreational services and facilities to the customer (“you”), including but not limited to: dance lessons, both private lessons and group classes within the UCan2 Dance Studio venue. All use of the facilities at UCan2 Dance Studio is undertaken according to the Terms and Conditions in this agreement. By purchasing a Dance Course and/or participation in a Group Class or Private Lesson at UCan2 Dance Studio, you are deemed to have accepted the Terms and Conditions in this agreement with UCan2 Dance Studio.

PARTICIPATION STATEMENT:
By participating you agree to the Terms & Conditions and Safety Rules & Restriction Guidelines below. You should be in good health to participate in physical activity and participate in accordance with these rules. It is the parents/guardians responsibility to ensure that their children adhere to these safety rules. If you encounter any problems or have any pre-existing medical conditions please discuss these with a staff member of UCan2 Dance Studio.

DISCLAIMER:
By agreeing to these Terms and Conditions, you acknowledge that dancing can sometimes be a dangerous pastime with inherent risks and hazards and, as a consequence, personal injury can occur and you assume and accept all such risks. UCan2 Dance Studio has taken every possible step to ensure that you have a completely safe and fun experience through the use of our beautiful dance studio and the employment of a qualified and experienced team. However, we cannot accept any responsibility for injuries sustained due to negligence on the part of the participants. For you to enter UCan2 Dance Studio premises, we will require that you confirm that you accept responsibility for you and your party during your time in the centre.

RELEASE:
Subject to the provisions in this agreement, you release, discharge and forever hold harmless UCan2 Dance Studio, its employees, directors and agents from all liability, obligation and responsibility of any nature for death or for any losses, damages or injuries relating to or arising directly or indirectly from your engagement in the recreational activity and from your participation in any related or incidental activities.

This Release shall be binding on your Estate and may be pleaded by UCan2 Dance Studio as a complete bar about any action, suit, claim or demand of any nature that you may bring against UCan2 Dance Studio or which may be brought on your behalf. This Release shall extend and shall apply to all conduct of UCan2 Dance Studio including, without limitation, the circumstances where the facilities pursuant to which the recreational activity takes place were not supplied with due care and skill or not fit for purpose or because of negligence, breach of contract, statute or statutory duty by UCan2 Dance Studio. In no event shall UCan2 Dance Studio be liable for loss of profit or consequential damages, whether based on breaches of contract, warranty or otherwise.

GENERAL GUIDELINES:
1. Course or Class fees include instruction from experienced teachers and the use of UCan2 facilities (excluding kitchen).
1. Please arrive 5-10 minutes prior to your booked session for processing and introduction.
2. Parents/Guardians remain responsible for their child’s welfare at all times. If one parent or guardian is bringing multiple kids, some of which are not his/her own, that adult is responsible for that group.
You are welcome to stay and watch. If you go from the studio during class, please make sure that you have left your contact number.
3. All bookings are subject to our Booking/Cancellation/Refund Policy stated in Terms and Conditions.
4. Participants must follow the below Safety Rules and Restriction Guidelines. Failure to abide by any of the guidelines may result in the cancellation of the remainder of your paid course or private lessons without compensation.

DANCERS MUST
1. Dancers must check-in before entering the dance floor.
2. Dancers must ensure footwear is clean before entering the dance floor.
3. Dancers must be aware of your surroundings and other dancers at all times.
4. Dancers must follow Staff instructions, Safety Rules and Restrictions at all times.
5. Dancers must report any accidents immediately.
6. Dancers must be responsible for any damage and will be charged for the repair at cost.
7. Dancers are financially responsible for any damage caused by failure to follow the directions of the Rules and Guidelines.
IMPORTANT: BE AWARE OF OTHER DANCERS

FEES, CHARGES AND TICKETS/PASSES:
All transactions are in New Zealand Dollars (GST inclusive). Fees and charges are shown on the UCan2 Dance Studio website and at the venue and are subject to change without notice. Booking online in advance is recommended to ensure space is available. You are required to pay the
session fee in full prior to being admitted into that session. Tickets/passes issued remain the property of UCan2 Dance Studio and are void if tampered with. Gift Cards are non-refundable and void after the 12 month expiry date. All UCan2 Dance Studio tickets/passes are valid only for the date and time shown and may not, without the prior communication and written consent of UCan2 Dance Studio, be resold or offered for resale at a premium or used for advertising, promotion or other commercial purposes either by you as the original purchaser or any subsequent bearer.
You acknowledge that despite UCan2 Dance Studio’s reasonable precautions, UCan2 Dance Studio products and services may be listed at an incorrect price, with incorrect information, or unavailable due to an error or oversight. In these circumstances, UCan2 Dance Studio reserves the right to cancel the transaction, notwithstanding that your booking has been confirmed and full payment has been made.

BOOKING POLICY - RESCHEDULING / CANCELLATION / REFUND:
At UCan2 Dance Studio, all bookings and services are non-refundable and non-transferable as you have agreed to our Terms & Conditions at your time of booking.

However, you are eligible to reschedule for your bookings giving at least a minimum of 24-hour prior notice or cancellations for your bookings giving at least a minimum of 7-day prior notice.

You need to contact UCan2 Dance Studio by using the CONTACT US (info@ucan2dance.co.nz) page on our website or TEXT 021-767997 with the minimum prior notice period and make the appropriate arrangements with one of our staff which will require confirmation by a new confirmation email from UCan2 Dance Studio.

*Please note there will be NO REFUND for no-shows on the day.
**Transaction Fees are 100% NON-REFUNDABLE.

RESCHEDULING
At UCan2 Dance Studio, all bookings are non-refundable and non-transferable.

Should you need to reschedule your booking, we will need a minimum of 24-hour prior notice. You are entitled to reschedule less a $5 administration fee per every transaction request.

Rescheduling is subject to availability. To reschedule, you need to contact UCan2 Dance Studio by using the CONTACT US (info@ucan2dance.co.nz) page on our website or TEXT on 021767997 giving at least 24-hour minimum period of prior notice and make the appropriate arrangements with one of our staff for a new date and time which will require confirmation by a new confirmation email from UCan2 Dance Studio.

Unfortunately, we are unable to offer any rescheduling if less than a 24-hour prior notice is given and then the non-refundable policy applies.

CANCELLATION
At UCan2 Dance Studio, all bookings are non-refundable and non-transferable.

Should you need to cancel your booking, we will need a minimum of 7-day prior notice. You will receive a UCan2 Dance Studio Gift Card (1 year expiry) with the value of your booking less a $5 administration fee.

Cancellation is subject to both parties’ agreement. To cancel, you must contact UCan2 Dance Studio by using the CONTACT US (info@ucan2dance.co.nz) page on our website or TEXT on 021767997 giving at least 24-hour minimum period of prior notice and make the appropriate arrangements with one of our staff which will require confirmation by a new confirmation email from UCan2 Dance Studio.

Unfortunately, we are unable to offer any cancellation if less than a 7-day prior notice is given and then the non-refundable policy applies.

PLEASE NOTE: All 8-week or 10-week term COURSES are non-transferrable and non-refundable after the commencement date

HEALTH AND EMERGENCY TREATMENT:
You acknowledge and are aware that the physical and mental exertion required to engage in the recreational activity and/or to participate in the activity can activate or aggravate a pre-existing physical condition, so you are required to be in good health and free from any adverse medical conditions. You are not permitted to participate in dancing if you are impaired by any medical conditions. You should always seek medical advice if you are in doubt about your health. You agree to pay the cost of, and authorise, UCan2 Dance Studio to take all steps it considers reasonably necessary to protect your welfare in the event of personal injury, including the administration of any emergency medical treatment and ambulance transportation.

HEALTH AND SAFETY REGULATION:
No food or drinks is permitted on the dance floor at UCan2 Dance Studio. Actions of Others: You acknowledge that that there are inherent risks that may arise from the actions of other participants and/or spectators that are not condoned by UCan2 Dance Studio, but which may nevertheless still occur, which include pedestrian traffic, irresponsible, unreasonable, excessive, reckless, careless, unkind, wanton and generally objectionable behaviour whether intentional or unintentional.

RIGHT TO REFUSE ENTRY:
UCan2 Dance Studio holds the right to refuse entry or cancel your access to use the facility if you are reasonably appear to be under the influence or in the possession of alcohol or illicit substances; fail to comply with Safety Rules and Restriction Guidelines and/or fail to follow the instructions of UCan2 Dance Studio staff; behave in an offensive, reckless, careless or threatening manner to other customers or staff; and are reasonably deemed to be a danger to yourself, other customers or UCan2 Dance Studio staff.

CONSENT FOR VIDEO, IMAGES AND EMAIL:
You acknowledge and give consent that, upon entering the UCan2 Dance Studio premises, you, and children for whom you are responsible, may be photographed and/or videoed for security, safety and promotional purposes. By providing your email to UCan2 Dance Studio you consent to receiving promotional and advertising material from time to time. By clicking “I have read and accept the Terms & Conditions” on the website, you agree to the following:

I acknowledge and agree with these UCan2 Dance Studio General Terms and Conditions.
I have read, understood and accepted the UCan2 Dance Studio’s Safety Rules and Restriction Guidelines.
I affirm that my health is good and my participation in UCan2 Dance Studio activities is voluntary.
